(Lanka-e-News -21.Dec.2024, 6.10 PM) A petition has been submitted to the Court of Appeal requesting a writ order to nullify the parliamentary membership of Dr. Upali Pannilage, the Minister of Rural Development, Social Security, and Community Empowerment.
The petition was filed by Oshala Herath, the chairman of the Abhinava Nivahana Peramuna, who had previously submitted a similar petition that led to the removal of Diana Gamage from her parliamentary seat.
The respondents in the petition include Minister Dr. Upali Pannilage, the Secretary-General of Parliament, the University of Ruhuna, and its Vice-Chancellor, among others.
The petitioner claims that Dr. Upali Pannilage was appointed as a National List MP to Parliament following the last general election. However, at the time of his appointment, he was reportedly serving as a Senior Lecturer in Sociology at the University of Ruhuna.
The petition argues that such an appointment while holding a government position violates Article 91 of the Constitution and is therefore unlawful. It also states that this disqualifies him from holding a parliamentary seat.
Oshala Herath has also filed a similar petition against Archana Ramanathan, who was appointed as an independent MP from Jaffna, claiming that she was serving as a hospital doctor at the time her nomination was submitted. The Court of Appeal has agreed to hear that petition as well.
