(Lanka-e-News - 02.Oct.2019, 11.00PM) When the appeal court took the case today 2nd October of Gotabhaya Rajapaksa whether he is a legal citizen of Sri Lanka or not the deputy solicitor general Nerin Pulle who appeared on behalf of Immigration and Emigration Controller R.M.P.B.S Ratnayake, told the court that the immigration does not have any files of his dual citizenship when the case was taken up for hearing.
Attorney-at-law Romesh de Silva, appearing for the respondent Gotabhaya Rajapaksa, stated that the Department of Immigration and Emigration was computerized in 2007 and he heard that all files before 2007 of the Immigration Department had been destroyed and the the Attorney General does not say anything about this.
Responding to this, Deputy Solicitor General Nerin Pulle said that the allegation was completely false and Immigration and Emigration Department has not destroyed any of such old files and the department has not find any documents related to Gotabaya.
The Department of Immigration and Emigration is one of the most important departments in the country maintaining citizenship documents. When this controversial dual citizenship certificate was issued the immigration and emigration department was under the national security ministry and its secretary was the same Gotabaya Rajapaksa and the minister was his brother Mahinda Rajapaksa.
These writ petitions have been filed seeking the issuance of a Certiorari writ order which revokes the passport, national identity card and dual citizenship certificates of Sri Lanka's Presidential candidate Gotabhaya Rajapaksa as he is not a Sri Lankan citizen. The writ petition was taken up today at the Court of Appeal before the bench of the court of appeal chairman Justice Yasantha Kodāgoḍa, Arjuna Obeysekera and Mahinda Samayawardhana.
Further hearing was postponed until 1.30 pm tomorrow
According to Lanka e News, Basil Rajapaksa obtained his dual citizenship in 2007. Gotabhaya also submitted his application on the same day, but his application states a false date as November 21st 2005. An eyewitness who saw these documents said to Lanka e-News that number of facts including the hand writing that make evident that Basil and Gota's applications were filled by one person on the same day. There is a 'Spelling Mistake in both documents which are similar. Both Basil and Gotha have been born in two different places but both applications states the same place of birth at Rahula Mawatha in Matara. It is clear that Gotabhaya, who knows that his application is fake has has corrupted the file under the Department of Immigration and Emigration.
