The decision of the SC on the 19 th amendment conveyed to speaker : some clauses where referendum needed withdrawn

(Lanka-e-News-09.April.2015, 11.30PM) The decision of the Supreme court (SC) regarding the proposed 19 th amendment to the constitution to vest the executive presidency powers in the parliament and activate the independent commissions ,which  was received by the speaker of the parliament was announced in parliament yesterday evening.

The decision taken by the panel of three judges of the SC including justice Sripavan was some of its clauses are conflicting  and if the amendment is to be passed with those clauses , a people’s referendum will become necessary. However the other causes are in order .

The prime minister Ranil Wickremesinghe apprised the parliament , the clauses that necessitate a referendum shall be withdrawn , and the constitutional amendment  be tabled. There are two such clauses , he added.  Those clauses which stipulate that  powers of the president be vested in the new P.M.

1.  Based on clause  42 (3) of the constitution , the head of the cabinet is P.M.

This clause shall be withdrawn , and the president shall again function as the head of the Cabinet 

2. The number of ministers and the portfolios of the ministers shall be decided by the P.M.

This clause shall be withdrawn and this power shall  again be vested in the president .

While the 19 th amendment was to be  tabled in parliament today and it was to be passed following a debate on it for two days, ,because the SC decision got delayed for a day and  the speaker announced the decision today , the 19 th amendment could not be tabled . In the circumstances , in all probability , the amendment will be tabled after the new year holidays , it is learnt.
