(Lanka-e-News -10.Feb.2016, 7.20PM) When Galagodaathe Gnanassara Thera the robed monk was produced yesterday (09) in court based on two charges : committing contempt of court and threatening victims , he was released on bail in respect of one indictment. However based on the other indictment , he was remanded again.
Gnanassara was produced before Homagama magistrate Ranga Dissanayake last noon from remand prison by the prison officials.
On the previous occasion , when the Ekneliyagoda case was called up , the SL Bar Association filed charges against the misbehavior of Gnanassara . While Lawyers Saliya Peiris and Alagaratnam appeared on behalf of the association, and lawyers for the Attorney General department were present on that day, Gnanassara sought to make his speech on his own , however yesterday , he had arranged for a lawyer to appear on his behalf , and that is lawyer Tirantha Wallaliyaddha .
In compliance with the request made by Wallaliyadda the magistrate released Gnanassara on bail. Gnanassara was accordingly enlarged on two personal bails of Rs. 100,000.00 each ,subject to two bail conditions that Gnananassara shall report to the Homagama police every Sunday, and until the case is concluded he should refrain from making statements to the media pertaining to the case. He was also sternly warned that if he violates the conditions he will be remanded again.
Thereafter Wallaliyadda requested bail in connection with the other case in which Gnanassara is charged with threatening Sandya Ekneliyagoda. The lawyer Upul Kumaraperuma appearing on behalf of Sandya however pointed out to court that the magistrate court is not empowered to grant bail relating to the charges filed in this case. He explained to court that Gnanassara is indicted under the provisions of protecting victims and witnesses , and bail can be granted only by the appeal court.
Wallaliyadda countered that by saying those provisions have not yet been gazetted. While the judge was examining the submissions , Kumaraperuma contacted solicitor Yasantha Kodagoda of the AG’s department via phone , when Kodagoda confirmed that the Act which protects victims has been gazetted. After this was passed to the magistrate , the latter instructed to forward a copy of the relevant gazette to court on the 10 th. Accordingly , Gnanassara was remanded again until the 10 th (today)
Hence , after the gazette copy is produced in court tomorrow , Gnanassara will be able to seek bail in the appeal court.
Gnanassara who was optimistic that he would get bail in the second case too after he was enlarged on bail in the first , on hearing that he will not be released in the second case was emotonally shaken . His eyes were flooded with tears. Gnanassara who berated all and sundry and disdained the laws as those of the Suddhas (Whites) ,and arrogantly said , he would not abide by those laws , when entering the prison vehicle to be taken back to the prison was visibly shocked , shaken , silent and crestfallen . Instead of his favorite quote ‘aba saranaiy’ , he was murmuring ‘sabbe saththa bavathu sukithaththa.’ In this life animals are known as having no human feelings , and hence they don’t cry , therefore Gnanassara crying is most puzzling.
It is significant to note that not one of those robed monks who created mayhem in courts on the first day when Gnanassara was produced in court and remanded, was seen around. Meanwhile the two robed monks Badalkumbure Ariyashantha and Magalkande Sudantha, the leader of Sihala Ravaya alias Gava Ravaya who are in remand custody for creating unrest on the court premises on the day Gnanassara was remanded , were produced before court and further remanded until the 16 th.
When the Ekneliyagoda case was taken for hearing yesterday , all the suspects were further remanded until the 26 th .
