| SC issues Interim Order against forcible transportation of Tamil lodgers |

(LeN- 2007 June 08, 7.45 pm) The Supreme Court today issued an interim order prohibiting the Police and the IGP evacuating Tamils residing in lodges in Colombo and the suburbs.
The order was delivered when a petition filed by the Executive Director of the Centre for Policy Alternatives Dr. Pakiasothy Saravanamuttu was taken up by the Supreme Court this morning.
Issuing the order the SC said that such an order has to be issued due to the state of emergency in the country.
When the petition was taken up Attorney M.S. Suhandiram who spoke on behalf of the petitioner said that lodes in Colombo were yesterday taken away forcibly to the North and East. He pointed out that it violates the Fundamental Rights section of the Constitution, as every citizen has a freedom of movement and residing in any part of the country with his/her consent. He therefore requested the SC to issue an Interim order to stop this move.
Speaking here, Supreme Court Judge Nimal Gamini Amaratunga said the court has to interfere in this matter as this is a very serious issue.
Accordingly the SC ordered the respondents sited in the petition IGP Victor Perera, OIC’s of the Kotahena, Wellawatte, Wattala and Pettah, Commanders of the three armed forces, Defence secretary and the Attorney General were asked to immediately halt the evacuation and asked them to appear before the court on the 22nd of this month when the case is being taken up next.
The petition was taken up before judges Nimal Gamini Amaratunga, Andrew Somawanse and Nimal Dissanayake.
Meanwhile the Centre for Policy Alternatives has sent a letter to the president asking him to interfere and stop the forcible transportation of Tamil lodgers. |
